Making a Lawyer a Power of Attorney

Post by Ebikatsu »

Only hire a reputable lawyer when making any type of transaction in Egypt.
This cannot be stressed enough.

Lawyers here are not subject to the same rules and regulations as you may find in your own country.

A POA for a lawyer is generally done to allow a party or several parties to be represented to the court by the Lawyer, therefore freeing the interested parties from attendance at court.

This type of POA is generally used in land or house purchases.

A POA for Lawyer does not have to have the lawyer attend the Notary Office but it would be wise to have them accompany you there. If they seem unwilling to or make excuses to attend with you, it would be an indicator to find another lawyer
;)

To make a Lawyer a POA you will need the lawyers name, address, id number and telephone number of his office if he is trusted and is not accompanying you to the Notary Office.

The clerk will then specify a POA for him with clear details on what you are allowing him to do, or what you want him to represent for you.
A document will be completed and lodged at that office with a number and after paying a fee you will be given a franked legal POA certificate which you must make a copy of for safekeeping, and hand the original to your lawyer so that he can present it to the judge to act on your behalf.
Once the transaction is complete you can go to the Notary Office and cancel the POA if it does not have an expiry date and all work is completed.

It is perfectly legal in Egypt to allow a POA for not only yourself but also for the seller if the seller is not available or does not want to go to the court with the lawyer for registering properties. The seller does not necessarily have to have a lawyer to complete a sales contract.

Never allow a POA for a lawyer that you do not completely trust. If you do not trust a lawyer then always find another you can. It will save you time and money.
